Welcome to Happy Dog Surf Shop. Please read these Terms carefully, as they constitute a legal agreement between you and Happy Dog Surf Shop. These Terms include an arbitration provision that requires most disputes to be resolved through binding arbitration, as well as an agreement not to participate in any class action or similar proceeding relating to these Terms.

Happy Dog Surf Shop ("Happy Dog," "we," "us") is a nonprofit clothing brand based in New York that donates 100% of its profits to animal shelters. We operate an online store via our website, happydogsurfshop.org, and other affiliated sites (collectively, the "Site"). These Terms and Conditions ("Terms") govern your use of the Site and any services or content provided by us (collectively, the "Services").

2. Applicability of Terms

By accessing or using the Site or Services, you agree to be bound by these Terms and affirm that you are of legal age to enter into this agreement. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Additional terms may apply to specific services or features, and those terms will become part of your agreement with us if you use those services.

3. Changes to Terms

Happy Dog reserves the right to revise these Terms at any time by posting an updated version on the Site. Your continued use of the Site after such changes constitutes your agreement to the revised Terms. The version of the Terms in effect at the time of your purchase will apply to that transaction.

All content on the Site, including text, graphics, logos, images, audio, and software, is owned by Happy Dog and protected under copyright, trademark, and other applicable laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, publicly display, create derivative works from, or exploit any part of the Site without our express written permission.

You agree not to:

  • Use the Site for any unlawful purpose.

  • Interfere with Site operations or security.

  • Use any automated means to monitor or copy content.

  • Upload or introduce malicious code.

6. Product Information and Final Sale Policy

We strive to present our products and pricing as accurately as possible. However, we do not guarantee the accuracy of any product descriptions or pricing information.

All purchases made through the Site are final sale. We do not accept returns or exchanges under any circumstances. Please review product details carefully before purchasing. As a nonprofit, all proceeds directly support our mission of helping shelter animals.

Prices are subject to change. Taxes and shipping charges are calculated at checkout.

10. Limitation of Liability

To the fullest extent permitted by law, Happy Dog shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to the use of the Site or Services.

Some jurisdictions do not allow limitations on implied warranties or liability, so some limitations may not apply to you.

11. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms, the Site, or Services shall be resolved through binding arbitration administered by the American Arbitration Association in New York County, NY. You and Happy Dog waive any right to a trial by jury or to participate in a class action.

13. Miscellaneous

No waiver of any term shall be deemed a further waiver of any other term. These Terms do not create any third-party beneficiary rights.
